Terms of Use

IMPORTANT: PLEASE REVIEW THESE TERMS OF USE BEFORE ACCESSING, USING, OR SUBMITTING ANY INFORMATION ON WWW.INSIGHTSWORK.COM ALONG WITH ALL SUBDOMAINS.

 

InsightsWork (“InsightsWork”, “we” or “our”) operates this Website (the “Site”) and provides the InsightsWork predictive people platform, including our psychometric assessment tools and related behavioral science services (the “Services”).

 

1. Acceptance of Terms

These Terms of Use govern access to and use of the Site by casual visitors, individual assessment takers, and potential customers (“you”). Each time you access or use this Site, you accept the terms and conditions set forth in these Terms of Use as well as the terms and conditions set forth in our Privacy Policy.

Note to Business Customers: These terms govern the use of the Site. Professional use of our Software by Organizations is additionally governed by a separate, mutually executed Master Service Agreement (MSA) or End User License Agreement (EULA).

 

2. Intellectual Property & Assessment Integrity

InsightsWork owns all intellectual property rights in the Site and Services.

  • Proprietary Science: The psychometric survey questions, algorithms, and behavioral models are proprietary trade secrets.

  • Interpretation Restriction: Assessment Results may only be interpreted and shared by individuals who have completed InsightsWork's required training or certification. InsightsWork disclaims all liability for "readbacks" or interpretations performed by unauthorized personnel.

  • Non-Commercial Use: Individual Users are granted a limited license to use their personal Results for personal development only. You may not use InsightsWork content to provide commercial consulting or third-party advisory services.

 

3. Organizational Responsibility (For B2B Clients)

Organizations using the Services must designate a “Primary Administrator” (Key Contact) who has the authority to represent the Organization and manage account administration.

  • The Organization remains at all times liable for the actions, data access, and compliance of all sub-users (recruiters, managers) invited to the platform under their account.

 

4. Data Ownership and De-identification

Consistent with our Privacy Policy, you agree that InsightsWork may de-identify and aggregate data derived from your use of the Services.

  • InsightsWork owns all such de-identified and aggregated datasets and may use them for any purpose, including the improvement of our predictive models and behavioral research.

 

5. Legal Compliance & EEOC Disclaimer

InsightsWork provides psychometrically validated tools designed to reduce bias. However:

  • Employer Responsibility: The Customer (Employer) is solely responsible for ensuring their overall hiring and management processes comply with local labor laws (e.g., EEOC in the US, GDPR in Europe).

  • Adverse Impact: InsightsWork assessments are intended to be one of multiple data points in a selection process. Employers are responsible for ensuring that their use of the tool does not result in an unjustified adverse impact on protected groups.

 

6. Warranty Disclaimer

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” BASIS. InsightsWork provides predictive insights based on behavioral science. We do not warrant that:

  • Assessment results are a guarantee of future job performance.

  • The Site will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties of merchantability and fitness for a particular purpose.

 

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INSIGHTSWORK’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE USE OF THE SITE SHALL NOT EXCEED $100.00 USD. We are not liable for any lost profits, hiring mistakes, or "intangible losses" resulting from your reliance on our predictive data.

 

8. Arbitration and Class Action Waiver

Any and all disputes arising out of these Terms shall be resolved exclusively through final and binding arbitration on an individual basis. You hereby waive any right to participate in a class action lawsuit or class-wide arbitration.

 

9. Governing Law

These Terms will be governed by and construed in accordance with the laws of the jurisdiction of Ontario, without regard to conflicts of law principles.
